Privacy Policy

Effective date: September 29, 2026

Honey Badger Growth Group (“we,” “us,” or “our”) operates the website on which this policy appears (the “Site”) and provides buyers group membership, negotiated pricing and rebates, software, and training services to HVAC companies (the “Services”). This Privacy Policy explains what personal information we collect, how we use and share it, how long we keep it, and the rights and choices you have. We are based in Texas and serve businesses across the United States, and we apply the privacy rights described below to all users regardless of where they live.

1. Information we collect

Information you give us. When you submit a contact form, interest form, or membership application, book a call, opt in to messages, or become a member, we collect the information you provide:

  • Identifiers and contact details: name, company name, business email address, phone number, and state.
  • Business information: your role, purchasing volume, current supplier, and the contents of any message you send us.
  • Commercial and account information: membership level, billing details, and transaction history. Payment card data is handled by our payment processor, and we do not store full card numbers.
  • Consent records: your opt-in choices, the exact consent language shown, its version, and the date, time, and IP address of your submission.

Information collected automatically. When you use the Site we collect IP address, browser and device type, operating system, referring page, pages viewed, and the date and time of your visit, through cookies, server logs, and similar technologies.

Information from other sources. We may receive information from service providers (for example, our scheduling and payment tools) and from suppliers or manufacturers when needed to deliver member pricing or rebates.

We do not knowingly collect sensitive personal information (such as government IDs, precise geolocation, health data, or financial account credentials) through the Site, and we ask that you do not submit it.

2. How we use your information

  • To respond to your inquiries, evaluate membership applications, and schedule calls.
  • To provide and administer the Services, including billing, member pricing, rebates, and training.
  • To send the communications you have opted in to receive (see sections 3 and 4) and service messages.
  • To operate, secure, troubleshoot, and improve the Site and Services, and to detect and prevent fraud and abuse.
  • To keep records of your consent and to comply with legal obligations and enforce our Terms & Conditions.

We do not use your information for automated decision-making that produces legal or similarly significant effects.

3. SMS / text message program

If you check the SMS opt-in box on one of our forms, or otherwise give us prior express written consent, you agree to receive recurring automated text messages (SMS/MMS) from Honey Badger Growth Group at the mobile number you provided. Messages may include replies to your inquiry, membership information, pricing and rebate updates, training reminders, and event notices.

  • Consent is not a condition of purchase or of membership.
  • Message frequency varies.
  • Message and data rates may apply. Check with your mobile carrier for details.
  • Opt out at any time by replying STOP (you may also use END, CANCEL, UNSUBSCRIBE, or QUIT). We will send one final message confirming that you have been unsubscribed, and no further messages will be sent unless you opt in again.
  • Get help by replying HELP to any message or by contacting us at luke@hbbuyers.com.
  • Mobile carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of sharing described in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Email communications

If you check the email opt-in box, we may send you emails about membership, pricing, rebates, training, and events. Every marketing email includes a working unsubscribe link, and we will honor your request within ten business days (and generally sooner). You may also email luke@hbbuyers.com to unsubscribe. We may still send you transactional or service emails relating to your inquiry or membership.

5. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose it only:

  • To service providers and processors who help us run the Site and Services (for example, email delivery, text messaging, scheduling, hosting, and payment processing). They may use the information only to perform services for us and are bound by confidentiality and data protection obligations.
  • To suppliers, manufacturers, or distributors when required to deliver member pricing or rebates you have requested, and only to the extent necessary.
  • When required by law, subpoena, or legal process, or to protect our rights, property, or safety or those of others.
  • In connection with a merger, acquisition, financing, or sale of assets, in which case we will notify you and the acquirer will be bound by this policy or must give you notice of any material change.
  • With your direction or consent.

As stated in section 3, text messaging opt-in data and consent are never shared with third parties for marketing purposes.

In the past 12 months we have disclosed identifiers, contact details, business information, commercial information, and internet activity data to the service providers described above for business purposes.

6. Cookies, analytics, and browser signals

The Site may use cookies and similar technologies that are necessary for it to work, to remember your preferences, and to understand how the Site is used. You can control cookies through your browser settings, though disabling them may affect some features. If your browser sends a Global Privacy Control (GPC) or similar opt-out preference signal, we treat it as a valid request to opt out of any sale or sharing of your personal information. We do not currently respond to “Do Not Track” signals because there is no common standard for them, but as stated above we do not sell your information or track you across other websites for advertising.

7. Data retention

We keep personal information only as long as reasonably necessary for the purposes described in this policy. As a general guide: inquiry and lead information is kept for up to 3 years after our last interaction; membership and billing records are kept for the life of your membership plus 7 years for tax and accounting purposes; and SMS and email consent records are kept for as long as you remain opted in and for at least 5 years afterward to document your consent history. We may keep information longer where the law requires or to resolve disputes and enforce our agreements. When information is no longer needed we delete or de-identify it.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a data breach affects your personal information we will notify you and the appropriate authorities as required by applicable law.

9. Your privacy rights

Depending on where you live (including under the laws of Texas, California, Colorado, Connecticut, Virginia, Utah, Oregon, and other states), you may have the right to:

  • Know and access the personal information we have about you and the categories of sources, purposes, and recipients, including a portable copy.
  • Correct inaccurate personal information.
  • Delete your personal information, subject to legal exceptions.
  • Opt out of the sale or sharing of personal information, targeted advertising, and profiling. We do not engage in these practices.
  • Limit the use of sensitive personal information. We do not collect it for purposes that would require this right.
  • Not be discriminated against for exercising any of these rights.

To make a request, email luke@hbbuyers.com with the subject line “Privacy Request.” We will verify your identity by matching the details you provide to information we hold, and we will respond within 45 days (we may extend once by a further 45 days where permitted, and we will tell you why). You may use an authorized agent to submit a request on your behalf, and we may ask for proof of their authority. Requests are free unless they are manifestly excessive or repetitive.

Appeals. If we decline your request, you may appeal by replying to our response or emailing luke@hbbuyers.com with the subject line “Privacy Appeal.” We will respond in writing within 45 days and explain the outcome. If your appeal is denied you may contact your state attorney general, including the Texas Attorney General, to submit a complaint.

California residents. Under California Civil Code section 1798.83, you may request information about disclosures of personal information to third parties for their direct marketing purposes. We do not make such disclosures.

Marketing choices. Reply STOP to any text message and use the unsubscribe link in any marketing email to opt out at any time.

10. Business-to-business information

The Site and Services are intended for businesses. Information about you in your role at a company (such as your business contact details) is treated as personal information under this policy, and the rights in section 9 apply to it.

11. Children

The Site and Services are intended for businesses and are not directed to anyone under 18. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us personal information, contact us and we will delete it.

12. Where we process information

We are based in the United States and process your information here. If you access the Site from outside the United States, you understand your information will be transferred to and processed in the United States, which may have different data protection laws than your country. The Site is not directed to residents of the European Economic Area, the United Kingdom, or Switzerland.

13. Third-party links

The Site may link to third-party websites or tools (such as our scheduling provider). We are not responsible for their privacy practices, and we encourage you to read their policies.

14. Changes to this policy

We may update this policy from time to time. The effective date at the top shows when it was last revised. If we make a material change we will post a notice on the Site and, where required, obtain your consent. Continued use of the Site after changes are posted means you accept the updated policy.
