Terms & Conditions
These Terms & Conditions (“Terms”) are a binding agreement between you and Honey Badger Growth Group (“we,” “us,” or “our”) and govern your use of our website (the “Site”) and our buyers group, pricing, rebate, software, and training services (the “Services”). By using the Site or Services, submitting a form, or becoming a member, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or Services.
1. Eligibility
The Site and Services are intended for HVAC businesses and their owners, leadership, and staff, and not for personal, family, or household use. You must be at least 18 years old and authorized to bind your company to these Terms. If you accept these Terms for a company, you represent that you have that authority and “you” includes the company.
2. Membership, fees, and renewal
- Membership is offered in levels, each of which includes the benefits described on the Site or in your order at the time you join. Benefits vary by level.
- Automatic renewal. Membership is billed monthly in advance and renews automatically each month at the then-current price until you cancel. By joining you authorize us and our payment processor to charge your payment method on file each billing period.
- Cancellation. You may cancel at any time by emailing luke@hbbuyers.com from the email address on your account. We will confirm your cancellation in writing. Cancellation takes effect at the end of the current billing period, you keep access until then, and you will not be charged again. Fees already paid are not refunded unless required by law.
- Price and benefit changes. We may change membership pricing or benefits with at least 30 days’ notice by email. Changes apply from your next billing period, and you may cancel before they take effect.
- Payment. You agree to keep your billing information current. If a payment fails we may retry it and suspend the Services until it is resolved. You are responsible for any applicable taxes.
- Supplier terms. Group pricing, rebates, and supplier terms are negotiated on behalf of members and are subject to the terms of the applicable supplier or manufacturer. We do not guarantee any particular price, rebate amount, or availability, and we are not a party to your purchases from suppliers.
3. Acceptable use
You agree not to:
- Share member-only pricing, rebate terms, training materials, or community content outside your company without our written permission.
- Use the Services to compete with, disparage, or interfere with Honey Badger Growth Group, its suppliers, or other members.
- Provide false information, impersonate another person or company, or use the Site for any unlawful purpose.
- Attempt to access, scrape, reverse engineer, or disrupt the Site or its systems, or introduce malware or automated tools that place unreasonable load on them.
- Use the Site or Services in violation of any applicable law, including antitrust and competition laws. You remain solely responsible for your own pricing and business decisions.
4. SMS / text messaging terms
When you opt in to text messages from Honey Badger Growth Group, you give your prior express written consent to receive recurring automated text messages (SMS/MMS) at the mobile number you provided, including messages sent using an automatic telephone dialing system. Messages may include replies to your inquiry, membership information, pricing and rebate updates, training reminders, and event notices.
- Consent to receive text messages is not a condition of purchase or of membership.
- Message frequency varies.
- Message and data rates may apply.
- To stop receiving messages, reply STOP at any time. You will receive one final confirmation message. You may also use END, CANCEL, UNSUBSCRIBE, or QUIT.

- Mobile carriers are not liable for delayed or undelivered messages.
- You represent that you are the owner or authorized user of the mobile number provided and will notify us if the number changes or is reassigned.
- We send messages only within permitted hours for the recipient’s area, and we honor opt-outs promptly.
- Mobile opt-in data and consent are not shared with third parties for marketing purposes. See our Privacy Policy.
5. Email communications
When you opt in to emails, we may send you information about membership, pricing, rebates, training, and events. Every marketing email includes an unsubscribe link, and you may also unsubscribe by emailing luke@hbbuyers.com. We will process unsubscribe requests within ten business days. Service and account emails may still be sent as needed to deliver the Services.
6. Intellectual property
The Site, its content, our training materials, Peach AI, and all related trademarks and logos are owned by Honey Badger Growth Group or its licensors and protected by intellectual property laws. Members receive a limited, non-exclusive, non-transferable, revocable license to use member content for their own business during their membership. All other rights are reserved.
Feedback. If you send us ideas or suggestions, we may use them without restriction or compensation to you.
7. Training and business information
Training, playbooks, community discussions, and other content are provided for general business education. They are not legal, financial, tax, or professional advice, and results vary. We make no promises about savings, rebates, revenue, or profit. You are responsible for decisions made for your own business.
8. Third-party services and links
The Site and Services may rely on or link to third-party tools and websites, including scheduling, payment, and supplier services. We do not control them and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms.
9. Disclaimers
The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Honey Badger Growth Group and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Site or Services, even if advised of the possibility. Our total liability for any claim will not exceed the membership fees you paid to us in the three months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnification
You agree to indemnify and hold harmless Honey Badger Growth Group and its owners, employees, and partners from any third-party claims, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of law, or your use of the Services.
12. Termination
You may stop using the Site or Services at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or misuse the Services. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules, and by applicable federal law. Before filing a claim, you agree to contact us at luke@hbbuyers.com and try to resolve the dispute informally for at least 30 days. If it is not resolved, any dispute will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction and venue. To the extent permitted by law, each party waives the right to a jury trial and to bring or join a class or representative action. Any claim must be brought within one year after it arises. This section does not limit rights that cannot be waived under the law of the state where you are located.
14. General
- Entire agreement. These Terms and the Privacy Policy are our entire agreement with you about the Site and Services and replace any earlier understandings.
- Severability. If a provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect.
- No waiver. Our failure to enforce a right is not a waiver of it.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control.
- Electronic communications. You consent to receive notices from us electronically, including by email at the address you provided.
- Accessibility. We aim to make the Site accessible to everyone. If you have trouble using it, contact us at luke@hbbuyers.com.
15. Changes to these Terms
We may update these Terms from time to time. The effective date at the top shows when they were last revised. For material changes we will give notice on the Site or by email. Continued use of the Site or Services after changes take effect means you accept the updated Terms.
